1. Nature of the Application

jb-health (“the Application”) is a private, single-user, non-commercial application operated by Justin Bailes (“the Operator”) for the Operator’s exclusive personal use.

The Application is not a service offered to the public. It has no users other than the Operator, accepts no registrations, charges no fees, and is not available for use by any third party. These Terms are published to satisfy Google’s OAuth application requirements and to state the basis on which the Application operates.

No part of this document constitutes an offer to provide a service to any person.

2. Permitted use

Use of the Application is restricted to the Operator, authenticating with the Operator’s own Google Account to retrieve the Operator’s own health and fitness data.

Any attempt by another party to access, authenticate against, or otherwise use the Application is unauthorised.

3. Not medical advice

The Application is a data retrieval and storage tool. It does not provide medical advice, diagnosis or treatment, and nothing it produces should be relied upon as such.

Consumer wearable devices are not medical instruments. The measurements the Application retrieves — including heart rate, heart rate variability, blood oxygen saturation, skin temperature, respiratory rate, sleep staging, irregular rhythm notifications and electrocardiogram data — are generated by consumer hardware and vendor algorithms of undisclosed and unvalidated accuracy. They are not a substitute for clinical measurement.

No clinical decision should be made on the basis of data retrieved or presented by the Application without independent evaluation by a qualified healthcare professional. Symptoms warranting medical attention warrant medical attention regardless of what this data shows.

4. No warranty

The Application is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

The Operator makes no representation that the Application will operate without interruption or error, that data retrieval will be complete or timely, or that retrieved data will be accurate. The Application depends on third-party services and APIs that may change, degrade or be withdrawn without notice.

5. Limitation of liability

To the fullest extent permitted by applicable law, the Operator shall have no liability to any person for any loss or damage of any kind arising out of or in connection with the Application, including loss of data, loss of profits, or any indirect, incidental, special, consequential or punitive damages.

As the Operator is the Application’s only user, this limitation is a statement of the basis on which the Operator uses their own software, and no third party acquires rights under these Terms.

6. Third-party services

The Application retrieves data from Google services via the Google Health API. Use of those services is governed by Google’s own terms and policies, not by these Terms. The Operator does not control, and is not responsible for, the availability, accuracy or continuity of those services.

The Application’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

7. Data handling

The Application’s handling of personal data is described in the Privacy Policy, which forms part of these Terms.

8. Availability and termination

The Operator may modify, suspend or discontinue the Application at any time, for any reason, without notice, and is under no obligation to maintain it.

9. Changes to these Terms

These Terms may be updated at any time. The effective date at the top of this document will be revised accordingly.

10. Governing law

These Terms are governed by the laws of England & Wales, without regard to conflict of law principles.
